Our San Diego-based law firm offers an expert Will-and-Estates Lawyer team with in-depth knowledge in Estate Planning and Probate Law for residents of El Cajon and a host of other communities.  Let’s delve a little deeper into how Wills and Estate Planning work and why their connection with one another is so important.

Wills – Even the Most Basic Can Become Probated

Having a last Will and Testament is important since it allows an executor to better deal with the complexities of Probate Court.  However, if no Living Trust exists, even the most basic Will would be subjected to the lengthy Probate process.

Probate can become very expensive and extremely time-consuming, especially if the decedent had property or other assets in multiple states.  Additionally, potential heirs or beneficiaries listed in a Will may be forced to wait one or more years before Probate Court proceedings become finalized.

Our Will-and-Estates lawyer team is ready to address any questions you may have regarding the drawing up of a Will or any concerns you may have regarding an existing Will.  When comparing a Will with a Living Trust, it is important to understand that a Living Trust can avoid Probate Court, but a Will, on its own, cannot.

A “Pour-Over” Will

A Pour-Over Will is used in conjunction with a Trust.  It allows assets that are not titled in the Trust to be directed into the Trust, upon one’s death.  This way, additional assets in individuals’ estates are not probated – they are “poured over” into the Trust.  One of our Will-and-Estates lawyers will be happy to discuss this with you in more detail, via a complimentary consultation.

A Simple Will

Unlike a Pour-Over Will, a Simple Will is not used with a Living Trust.  It caters to those who have very simple estates that may not involve any real property or minor children, for example.  Property and other assets associated with a Simple Will are subject to Probate.

No matter what type of Will you might choose, the way to bypass Probate is to establish a Revocable Living Trust or an Irrevocable Living Trust.  Let’s face it, legalities surrounding Wills can become more complicated than one might have imagined.  The good news is our Will-and-Estates Lawyer team is highly familiar with the intricate details of these types of issues, and we’re here to put your mind at ease!

Estate Planning – Make It Your Priority

One of the most important aspects of being prepared for the future is creating a Comprehensive Estate Plan that would include a Living Trust.  At The Lawyer In Blue Jeans Group, it is our responsibility to make sure our El Cajon clients are protected from the nightmarish scenarios that the Probate process, typically, involves.

A Comprehensive Estate Plan is the best way to provide concise instructions for the transfer of your assets to your heirs, outside of Probate Court.  A Living Trust component ensures the proper management of your finances and healthcare if you become incapacitated.  Our El Cajon clients have peace of mind knowing this vital legal option bypasses Probate Court involvement that would come with excessive fees and costs.

At The Lawyer In Blue Jeans Group, our Comprehensive Estate Planning helps families and individuals of El Cajon with any of their needs surrounding Living Trusts, Wills, Power of Attorney, Advance Health Care Directives, Trust Administration, and Entity Formation.
